\nEn una primera aproximaci\u00f3n a la doctrina interpretativa del Tribunal Europeo de Derechos Humanos (en adelante, TEDH) las garant\u00edas inherentes al principio de legalidad recogido en el art\u00edculo 7 de la Convenci\u00f3n Europea de Derechos Humanos (en adelante, CEDH) se despliegan esencialmente respecto de la definici\u00f3n de los delitos y las penas. Una mirada m\u00e1s atenta, sin embargo, revela matices que ponen en tela de juicio que dicho art\u00edculo 7 no deba proyectarse tambi\u00e9n sobre la fase de ejecuci\u00f3n de las penas con un est\u00e1ndar igualmente riguroso. La presente contribuci\u00f3n se centra en describir, contextualizar y fundamentar esta tendencia expansiva de las garant\u00edas del principio de legalidad en la jurisprudencia del TEDH. Para ello tambi\u00e9n ser\u00e1 objeto de estudio la Sentencia del TEDH de 10 de julio de 2012, caso Del R\u00edo Prada c. Espa\u00f1a, como \u00faltimo ejemplo paradigm\u00e1tico al respecto.

\nAbstract<\/strong>
\nPrima facie interpretation of case-law by the European Court of Human Rights (ECtHR) suggests that safeguards inherent to the principle of legality (rule of law) enshrined in article 7 Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) should be taken seriously only in relationship with the definition both of crimes and penalties. However, a closer approach reveals new perspectives towards an application of the mentioned article 7 to the enforcement phase. This paper aims at describing, analyzing and putting in perspective this new development consisting of an expansion of guaranties for protecting the rule of law. For that purpose special attention will be also devoted to a sound ruling of the ECHR from 10th July 2012 (Case Del R\u00edo Prada v. Spain).
