\nResumen<\/strong>
\nEl fin de la actividad terrorista no ha supuesto un t\u00e9rmino final para la victimizaci\u00f3n generada por ETA. Sus efectos siguen presentes en la sociedad vasca, reclamando la atenci\u00f3n institucional tanto en el cuidado y reparaci\u00f3n integral, como en lo relativo al esclarecimiento de la verdad y la lucha contra el olvido y la impunidad, \u00e1mbitos en los que la adopci\u00f3n de una perspectiva victimol\u00f3gica y de justicia restaurativa resultan del mayor inter\u00e9s. Las exigencias se extienden igualmente a las vulneraciones de derechos humanos que se generaron desde los agentes p\u00fablicos con su aquiescencia o tolerancia. Conviene insistir en las distancias criminol\u00f3gicas y victimol\u00f3gicas existentes entre ambos fen\u00f3menos, y evitar la confusi\u00f3n en su tratamiento normativo e institucional. Por lo que se refiere a la victimizaci\u00f3n procedente del abuso de poder, una ley de prevenci\u00f3n de la tortura, malos tratos y reparaci\u00f3n integral de las v\u00edctimas constituir\u00eda un instrumento apropiado desde la \u00f3ptica victimol\u00f3gica, dadas las insuficiencias que presentan los mecanismos penales y procesales tradicionales. \nAbstract<\/strong>
\nThe end of terrorist activity has not brought to a definitive end the victimization generated by ETA. Its effects are still present in Basque society, demanding institutional attention both in comprehensive care and reparation and in the bringing to light of truth and in the struggle against forgetfulness and impunity, areas in which the adoption of a perspective grounded in victimology and restorative justice are of the greatest interest. Related demands also extend to the violations of human rights that were perpetrated by public agents or with their acquiescence or tolerance. It is important to insist on the criminological and victimological distances between these two phenomena, and to avoid confusion in their normative and institutional treatment. With regard to the victims of the authorities\u2019 abuse of power, a law for the prevention of torture and ill-treatment and the provision of comprehensive reparation of victims would constitute an appropriate instrument from a victimological point of view, given the inadequacies of traditional criminal and procedural mechanisms. \nLa fi de l\u2019activitat terrorista no ha suposat un terme final per a la victimitzaci\u00f3 generada per ETA. Els seus efectes continuen presents en la societat basca, reclamant l\u2019atenci\u00f3 institucional tant en la cura i reparaci\u00f3 integral, com pel que fa a l\u2019aclariment de la veritat i la lluita contra l\u2019oblit i la impunitat, \u00e0mbits en els quals l\u2019adopci\u00f3 d\u2019una perspectiva victimol\u00f2gica i de just\u00edcia restaurativa resulten del major inter\u00e8s. Les exig\u00e8ncies s\u2019estenen igualment a les vulneracions de drets humans que es van generar des dels agents p\u00fablics amb la seva aquiesc\u00e8ncia o toler\u00e0ncia. Cal insistir en les dist\u00e0ncies criminol\u00f2giques i victimol\u00f2giques existents entre tots dos fen\u00f2mens, i evitar la confusi\u00f3 en el seu tractament normatiu i institucional. Quant a la victimitzaci\u00f3 procedent de l\u2019ab\u00fas de poder, una llei de prevenci\u00f3 de la tortura, maltractaments i reparaci\u00f3 integral de les v\u00edctimes constituiria un instrument apropiat des de l\u2019\u00f2ptica victimol\u00f2gica, ateses les insufici\u00e8ncies que presenten els mecanismes penals i processals tradicionals.
