\nLa reciente noticia de la reactivaci\u00f3n de encuentros restaurativos entre exmiembros de ETA y v\u00edctimas de los delitos cometidos por esa organizaci\u00f3n (al hilo de la experiencia desarrollada en Nanclares de Oca en 2011, y con muchas similitudes con una experiencia vivida en Italia) ha vuelto a despertar el inter\u00e9s y el debate acerca de la aplicaci\u00f3n de mecanismos de justicia restaurativa a sujetos acusados de, y condenados por, delitos de terrorismo. Mientras que su aplicaci\u00f3n en la fase de ejecuci\u00f3n de la pena se ha mantenido, hasta ahora, separada de la evoluci\u00f3n penitenciaria, sin repercutir positivamente en ella, esta contribuci\u00f3n propone considerar la posibilidad de que la participaci\u00f3n de los internos en estos encuentros no solamente sea valorada como indicio de su resocializaci\u00f3n, sino tambi\u00e9n que pueda cumplir la condici\u00f3n de \u201cpetici\u00f3n de perd\u00f3n\u201d a las v\u00edctimas, que la legislaci\u00f3n penitenciaria y la jurisprudencia exigen para que los condenados por estos delitos puedan acceder al tercer grado, a la libertad condicional y a otros beneficios. Recuperar y conceptualizar este mecanismo restaurativo bajo este prisma permitir\u00eda superar, al menos en parte, los cortocircuitos a los que est\u00e1 dando lugar la aplicaci\u00f3n de estas condiciones especiales para la evoluci\u00f3n penitenciaria de los condenados por delitos de terrorismo. \nAbstract<\/strong>
\nThe recent news according to which the restorative encounters between former ETA members and their victims (following the experience developed in Nanclares de Oca in 2011, as well as a similar Project that took place in Italy) are going to resume very soon, have ignited the interest and the debate about the applicability of restorative justice mechanisms to people charged with, and convicted of, terrorist offences. Although their application during the serving of the sentence has been kept, up to now, separated from the evolution of the inmate, with no positive impact on it, this article argues that we could consider the possibility for the participation of the inmates in these encounters to be taken into account not only as an indicia of their re-education, but also as a way of fulfilling the requirement of the \u201casking for forgiveness\u201d, which penitentiary laws and jurisprudence envisage for people convicted of terrorist offences to be allowed to the third grade penitentiary situation, parole and other benefits. Recovering and conceptualizing this restorative mechanism under this perspective would allow to overcome, at least partially, the short circuits caused by the application of such special conditions to the evolution in prison of terrorist offenders.
