\nEn julio de 2015, el Juzgado Central de Instrucci\u00f3n n.\u00ba 3 de la Audiencia Nacional admiti\u00f3 a tr\u00e1mite una querella interpuesta contra la banda terrorista ETA, para investigar si los hechos cometidos con posterioridad al 1 de octubre de 2004 \u2013fecha en la que entr\u00f3 en vigor la reforma del C\u00f3digo Penal que tipific\u00f3 el delito de lesa humanidad\u2013, pod\u00edan ser constitutivos de este delito. En el presente art\u00edculo se analizan varias resoluciones dictadas por la Audiencia sobre este particular durante la fase de instrucci\u00f3n, y se ponen en relaci\u00f3n con la interpretaci\u00f3n de los elementos t\u00edpicos del delito de lesa humanidad. En concreto, se analiza el controvertido asunto de si una organizaci\u00f3n como ETA podr\u00eda ser id\u00f3nea para lanzar un ataque caracter\u00edstico del delito de lesa humanidad, as\u00ed como el concepto de poblaci\u00f3n civil y su limitaci\u00f3n como objeto de protecci\u00f3n de la norma. \nAbstract<\/strong>
\nIn July 2015, the Central Court of Instruction No. 3 of the National Court declared admissible a complaint iled against the terrorist group ETA, to investigate whether the acts committed after October 1, 2004 \u2013the date on which entered into force the Penal Code deining the crime against humanity\u2013 could be constitutive of the crime. In this article several decisions issued by the Court on this matter during the investigation stage are analyzed and placed in relation to the interpretation of the typical elements of the crime against humanity. Speciically, the controversial issue of whether an organization like ETA might be appropriate to launch an attack characteristic of the crime against humanity is analyzed, and the concept of civilian population and its limitation as an object of protection of the crime against humanity.
